Just because Nationsls MP for New England Barnaby Joyce is now sitting on the backbenches in disgrace doesn't mean the Turnbull Government can ignore all those dodgy water deals he made


Example of a dodgy water deal par excellence where a Cayman Islands corporation can pocket $78.8 million from a suspect water sale in the beleaguered Murray-Darling Basin........

Eastern Australia Agriculture Pty Ltd (EAA) was incorporated in 2007 and is based in St George, Australia. It operates as a subsidiary of Eastern Australian Irrigation Limited.

According to The Courier Mail on 21 March 2018; the company is based in the tax haven of the Cayman Islands.

The Land reported on 19 October2011 that; EAA shareholders are based in Grand Cayman in the Cayman Islands. Its directors include former Ridley Corporation managing director Matthew Bickford-Smith and former Colly Farms's grower services manager Peter Cottle.

EEA’s portfolio comprises two properties - “Kia Ora” (7km south of St. George) and “Clyde” (10km south-west of Dirranbandi) totalling 37,590ha made up of 12,800ha of cotton producing irrigation land with further areas of development potential.

These properties are close to the notorious water harvester,“Cubbie Station”, in the Condamine-Balonne Valley.

EAA’s entire properties, including the water licences were reported to have been independently valued at est. $107m in 2017.

In 2017 the Turnbull Government agreed to purchase over 29 gigalitres of water for $80,041,455  from EEA, which originally insisted on $2,200 per megalitre. But after negotiation, the Government paid a higher price - $2,745 per megalitre.

Then Deputy Prime Minister and Minister for Water, Barnaby Joyce, approved the final purchase of 29,159 megalitres of OLF licences in May 2017 - 14,969 ML from “Clyde” and 14,190 from “Kia Ora”.

Department of Agriculture and Water Resources (DAWR) due diligence later reduced the total volume to 28,740 megalitres and the price paid to $78,891,300.

The water purchased was for Over Land Flow (OLF) licences, which cannot be traded between irrigators, because they are attached to land. They have no legal status or any recognition at a location other than where they were originally purchased. That is, there appears to be no legal basis for the Commonwealth to ensure it gets to the places it is intended to be used. [The Australia Institute, March 2018, “That’s not how you haggle”, p.3]

The sale of EAA’s OLF licences represented 74% of the value of both EAA properties.

EAA recorded a $52m gain on the sale in their 2017 Annual Report. [ibid, p.8]

The purchase appears to be in breach of the Commonwealth Procurement Rules because it was not made available to all licence holders in the valley…. [ibid, p.3]

A brief scrutiny of the byzantium maze that is Cambridge Analytica


Attempting to make sense of a group of corporate actors who obviously delighted in establishing a veritable labyrinth of companies and to create a reference to follow any future revelations.........

So what does the British-US company Cambridge Analytica which; 
(i) has been accused of rat f**king the 2015 Nigerian presidential election and the 2013 & 2017 Kenyan elections
(ii) allegedly influenced the 2016 UK Brexit referendum vote by assisting the Leave.EU campaign
(iii) was known to have purchased data from Global Science Research Ltd who harvested personal details from an est. 50 million Facebook user accounts and, 
(iv) later sold a breakdown of user data first to a number of GOP candidates during 2014 midterms, as well as to Ted Cruz during the US primaries and then to Donald Trump during the 2016 US presidential campaign,
actually look like on paper?

This appears to be the company whose business name is included in so many media reports at the moment:

Cambridge Analytica LLC incorporated in Delaware USA on 31 December 2013 offering data mining, analysis, and behavioral communication solutions according to Bloomberg.com and, now considered a subsidiary of SCL Group Limited.

“The genesis of Cambridge Analytica was to address the vacuum in the US Republican political market that became evident after [Mitt] Romney’s defeat in 2012” [Alexander Nix, CEO Cambridge Analytics].

SCL Elections Limited is described by Cambridge Analylitica as "an affiliate of Cambridge Analytica" and also the "genisis" of Cambridge Analytica. It is now being blamed for receiving harvested Facebook data and Cambridge Analytica is hypocritically trying to distance itself in a company media release on 23 March 2018.

The Cambridge Analytica website states it has offices in London, New York, Washington DC, Brazil and Malaysia. Until 20 March 2018 Alexander Nix was listed as its CEO. Acting CEO is now Chief Data Scientist at SCL Group Limited Dr. Alexander Tayler.

How do two firms on opposite sides of the world - one of which has only one director/owner and no indentifiable board members - suddenly become this company with reputed influence and tentacles everywhere?

Perhaps the answer lies in the est. US$15 million in indirect funding Cambridge Analytica has allegedly received from right-wing American billionaire Robert Mercer & his daughter Rebekah through one or all five affiliated US 'front' companies including Cambridge Analytica LLC and in its relationship with another UK corporation with which it shares information/data/personnel.

BACKGROUND

The Sydney Morning Herald, 23 March 2018:

Wylie, a Canadian citizen, moved to London in 2010 and started to work in 2013 for SCL Group, which he said conducted "information operations" around the world and also worked in campaigns, especially in African nations.

As research director, Wylie helped that company give birth to Cambridge Analytica as "an American brand" that would focus on US politics with at least $US10 million from billionaire hedge fund manager Robert Mercer. The Cambridge Analytica office was in the posh Mayfair neighbourhood of London, and the dozens of young workers - many of them contractors, a number of whom were from Eastern Europe - buzzed about with Apple laptops.

At the helm, said Wylie, was Mercer's daughter Rebekah, who was president, and conservative strategist Steve Bannon, who was vice president. Running day-to-day operations was a smooth-talking upper-crust Briton, Alexander Nix……

Wylie said that it was under Nix's direction - but with the knowledge of Bannon and Rebekah Mercer - that Cambridge Analytica began an ambitious data-gathering program that included tapping into the Facebook profiles of 50 million users through the use of a personality-testing app. The company did that with the help of a Russian American psychologist at Cambridge University, Aleksandr Kogan, who also made regular visits back to Russia, according to Wylie.

Wylie said he and others at Cambridge Analytica were initially skeptical of the power of this tactic for gathering data. But when the company approved $US1000 for Kogan to experiment with his app, he produced data on 1000 people who downloaded it and roughly 160,000 of their friends - all in a matter of hours.

Cambridge Analytica next approved $US10,000 for a second round of testing and was rewarded with nearly a million records, including names, home towns, dates of birth, religious affiliations, work and educational histories, and preferences, as expressed using the popular Facebook "like" button on many social media updates, news stories and other online posts.

They soon married that data with voter lists and commercial data broker information and discovered they had a remarkably precise portrait of a large swath of the American electorate.

Kogan's app, called "thisisyourdigitallife" and portrayed as being for research purposes, gathered data on the 270,000 people who downloaded it and tens of millions of their Facebook friends. It was this data and others that Wylie later worried might have ended up in Russian hands.

"I'm not saying that we put it on a drive and posted it to Vladimir Putin on Number 1 Red Square," Wylie said, referring to the Russian president's official residence. But he said that he and others affiliated with Cambridge Analytica briefed Lukoil, a Russian oil company, on its research into American voters.

What was not known, until February, was the relationship between all these figures and the Leave campaign. That was when Andy Wigmore, Leave.EU’s communications director, revealed to this paper that Farage was a close friend of both Bannon and Mercer. He said that the Leave campaign was a “petri dish” for the Trump campaign. “We shared a lot of information because what they were trying to do and what we were trying to do had massive parallels.”

Wigmore also said that Mercer had been “happy to help” and Cambridge Analytica had given its services to the campaign for free. It was the general secretary of Ukip, a British lawyer called Matthew Richardson, who effected Leave.eu’s introduction to Cambridge Analytica, Wigmore said. “We had a guy called Matthew Richardson who’d known Nigel for a long time and he’s always looked after the Mercers. The Mercers hadsaid that here’s this company that we think might be useful.”

He said that Mercer, Farage and co had all met at a conference in Washington. “The best dinner we ever went to. Around that table were all the rejects of the political world. And the rejects of the political world are now effectively in the White House. It’s extraordinary. Jeff Sessions. [Former national security adviser Michael] Flynn, the whole lot of them. They were all there.”

When the Observer revealed Mercer’s “help” in February, a “gift” of services, it triggered two investigations. One by the Information Commissioner’s Office about possible illegal use of data. And another by the Electoral Commission. Cambridge Analytica is a US company and Mercer is a US citizen and British law, designed to protect its electoral system from outside influence, expressly forbids donations from foreign – or impermissible – donors. The commission is also looking into the “help” that Gunster gave the campaign. It was not declared in Leave.EU’s spending returns and if donated, it would also be impermissible. Gavin Millar QC, an expert in electoral law, says it raises questions of the utmost importance about the influence of an American citizen in a UK election.

But the contents of this document raise even more significant and urgent questions. Coordination between campaigns destroys the “level playing field” on which UK electoral law is based. It creates an unfair advantage.

Millar said that one of the significant and revealing aspects of the arrangement was that it was hidden. “It’s the covert nature of the relationship between these two companies and campaigns that I find particularly revealing and alarming. If there is covert cooperation via offshore entities, [it] is about as serious a breach of the funding rules as one can imagine in the 21st century.”

Millar said that this case was without precedent. “To have a billionaire so directly buying influence in a British election is absolutely unheard of. This is completely out of the ordinary. And what’s clear is that our electoral laws are hopelessly inadequate. The only way we would be able to find the truth of what happened is through a public inquiry.”

The link between Cambridge Analytica and AggregateIQ was never supposed to come to light. And it is still uncertain how Vote Leave came to work with AggregateIQ.
There are several major Tory donors and pro-Brexit figures associated with Cambridge Analytica and SCL Elections, including Lord Marland, former treasurer of the Conservative party and head of the Commonwealth Enterprise and Investment Council. The pro-Brexit Tory donor Roger Gabb, the owner of South African wine company Kumala, is also a shareholder and was involved in one of the Leave campaigns. In a separate incident he was fined £1,000 by the Electoral Commission for failing to include “imprints” – or campaign branding – on newspaper ads.

The Observer revealed last week that two core members of the Vote Leave team used to work with both Cambridge Analytica and AggregateIQ. Cummings said that he found the company – on which he spent by far the biggest chunk of his campaign budget – “on the internet”.

Citizens for Responsibility and Ethics in Washington (CREW), media release, 20 March 2018:

Washington—A federal judge today granted Citizens for Responsibility and Ethics in Washington (CREW) summary judgement in its landmark case against the Federal Election Commission (FEC), the second time the Court has ruled against the FEC for dismissing CREW’s complaint against a dark money group that spent millions in federal elections.

Judge Christopher Cooper ruled in September 2016 that the FEC acted “contrary to law” by dismissing a complaint against American Action Network (AAN), which spent millions on ads without revealing its donors, finding that the FEC’s analysis “blinks reality” and returning the case to the FEC to correct its error. Nevertheless, the three Republican commissioners once again blocked action against the organization, leading Judge Cooper today to correct the commissioners on their continued failure to follow the law.

This decision will have a major impact on disclosure by dark money groups, as the FEC can no longer ignore organizations’ spending on ads that air just before an election that try to hide their political purposes behind a sham “call” for viewers to contact their representatives about legislation.

“This decision marks a major victory not just for CREW but for believers in an open and transparent political process,” CREW Executive Director Noah Bookbinder said. “We hope to see a major change in the way the FEC approaches investigations of nonprofit organizations engaged in politics.”

The case revolves around clearly political ads aired by AAN which the FEC decided were not meant to influence an election. The judge wrote in the first decision that “it blinks reality to conclude that many of the ads considered by the Commissioners in this case were not designed to influence the election or defeat of a particular candidate.” Yet the FEC still failed to act. The judge wrote in today’s decision, “The controlling Commissioners did not find that this ad (nor any others mentioning healthcare) had an election-related purpose…Seriously?”

“It’s a shame we have to keep taking the FEC to court to make it do its job,” Bookbinder said. “Unfortunately, they have given us no other choice. If they do not want to keep losing in court, they should start enforcing the law.”

Federal Liberals behaving badly in 2018


This was the Liberal MP for Leichardt and Chair of Joint Standing Committee on Northern Australia Warren George Entsch on 7 March 2018 at warrenentsch.com.au.....

Federal Leichhardt MP Warren Entsch is calling for big ideas from the community that could help shape the future of the region.

Mr Entsch said the $272 million Regional Growth Fund would support major projects in regional, rural and remote areas that delivered long-term economic benefits.
“This is an exciting program that is set to deliver major projects over $20 million that take advantage of the region’s natural economic strengths,” Mr Entsch said.

“The Regional Growth Fund will support additional investment for sustainable economic growth, including from the private sector, other levels of government, and not-for-profit organisations.

“Initial applications close on 27 April 2018 and I encourage everyone eligible in our community to look at the program guidelines and get started on an application.”

Mr Entsch said the Federal Government would invest a minimum of $10 million toward each successful infrastructure project, representing a maximum of 50 per cent of project costs.

It was a long and tough election campaign for Prime Minister Malcolm Turnbull. He finally buckled late in the 2016 race and matched Labor’s pledge to fund the final $100 million to build Townsville’s stadium.

It was a welcome boost to Coalition MPs but Leichhardt MP Warren Entsch needed a lift too.

Mr Turnbull threw him a bone in the form of a $20 million regional jobs and investment package.

It wasn’t a $100 million pledge but it struck at the heart of something the region desperately needed: jobs.

The announcement received a lot of media and Mr Entsch was delivered another term in Canberra.

But 100 days after the Coalition was sworn in there was little action and even less in the way of detail on how businesses could access the funding. Time dragged on until Advance Cairns chairman and campaign director for Mr Entsch, Trent Twomey was named chairman of the Local Planning Committee for the fund in January 2017.

Among the committee’s brief was to set the eligibility criteria. The application process was finally rolled out, closing in July 2017. Throughout the process the Cairns Post has watched, waited and asked questions to ensure the fund was not just a hollow election promise. After 20 months Mr Entsch announced in February a list of recipients; among them was a $2.4m grant for QRX Group 1 to establish a first for FNQ — a pharmaceutical manufacturing and distribution centre. The project, never heard of until the announcement, has raised many eyebrows. There are questions that need answering about the true number of jobs it will generate, a key criterion of the funding, and if there is a real conflict of interest with Mr Twomey’s wife a one-third owner of QRX Group 1.

Leichardt MP Warren Entsch could face a quizzing over how the wife of his campaign director Trent Twomey won a $2.4 million federal grant to expand her family pharmaceutical empire.

The Australian Federal Police is looking into a formal complaint of alleged fraud and misconduct in the handling of the multi-million dollar handout.

Far North civic and business leaders told the Cairns Post many taxpayers held concerns about LNP pork-barrelling and whether it “passes the sniff test”.

Mr Entsch, whose son works for the pharmacy company behind the deal, said it was a “brilliant project” and he was outraged by suggestions “about fraud and corruption” over the $220m Regional Jobs and Investment Package (RJIP).

“It ticked all the boxes,’’ he said.

Mr Entsch appointed his election campaign manager Trent Twomey, a local pharmacist and Advance Cairns chairman, to head an RJIP committee panel to identify key priorities for $20m in federal grants to stimulate jobs growth and investment.

The shelf company QRX Group 1 – where Mr Twomey’s wife Georgina and business partner Leo Maltam are listed in company records as directors – won $2,415,400 in funds to build a $5m pharmacy distribution facility……

The Australian Federal Police has been referred a formal complaint but are yet to launch an official “active” fraud investigation. An AFP spokesman suggested the matter might be referred to the Department of Regional Development’s internal probity and audit unit.

Business leaders and pharmacy owners said the vision to build Northern Australia’s first pharmaceutical manufacturing and distribution centre was unheard of until the grant was announced two weeks ago.…….
