In New South Wales 75 hectares of wildlife habitat and carbon storage is bulldozed or logged every day. Something to remember when filling in your ballot paper at the March 2023 state election

75 hectares of habitat lost each day in NSW


Latest land clearing data shows 75 hectares of wildlife habitat is bulldozed or logged every day in NSW, almost twice the average annual rate recorded before the Coalition overhauled nature laws in 2016. [1]


The annual Statewide Land and Tree Study (SLATS) data shows 27,610 hectares of native forest were destroyed for farming, forestry and development in 2020.


This astounding rate of deforestation is a disaster for wildlife and the climate. We call on the government to take urgent action to reverse the trend,” Nature Conservation Council Chief Executive Chris Gambian said.


In just one year we have lost an area of native forest nearly double the size of Royal National Park. It is simply unsustainable.


Using widely accepted data on wildlife population densities, clearing on that scale would have killed up to 4.6 million animals - mammals, birds and reptiles – in just 12 months. [2]


Native forests in NSW can absorb up to 44 tonnes/hectare of C02 annually [3].


Protected from logging, NSW public native forests could store an additional 900 million tonnes of CO2 - equivalent to six years of NSW emissions.


These forests are a critical carbon sink that we need to protect to pursue meaningful action on climate change.


After the government weakened land clearing laws in 2016, deforestation rates doubled and have remained at these dangerously high levels ever since.


The Coalition promised it’s new laws would enhance protections for bushland and wildlife.


These figures, and the rising number of threatened species, shows the laws completely fail to deliver on that promise.


More than 1,040 plants and animals are now threatened with extinction in NSW, about 40 more than when the scheme was introduced.


The government must stop uncontrolled deforestation on private land and in state forests if it is going to tackle the extinction crisis.”


The SLATS data show a 43% increase in the amount of vegetation cover lost in production forests, presumably due to the 2019-20 Black Summer Bushfires.

Less than a month after New South Wales Port Macquarie MP Leslie Williams sensationally quit the National Party to join the Liberals, the defector was in direct conversations with then treasurer Dominic Perrottet’s office about a controversial $5 million grant to a private nursing home in her electorate.


The building project – for a new community centre, as part of a wider redevelopment of the St Agnes’ Care and Lifestyle facility in the coastal town that gives the state seat its name – was not part of any NSW government program. It was not on the radar of any official, or recommended by bureaucrats. Senior Treasury officials warned the state government’s powerful expenditure review committee (ERC) that the funding made no sense and should not be supported.


Instead, exactly one week after Leslie Williams forwarded details of the aged-care company’s development application to Perrottet’s ministerial staff, the $5 million grant was approved by the ERC, which was led by Perrottet and then premier Gladys Berejiklian.


The money was not new funding. It had to be found from elsewhere in the Health budget. As the coronavirus pandemic raged, the $5 million was taken from the Department of Health’s general spending budget and handed to St Agnes’ Care and Lifestyle for capital works on land owned by the Roman Catholic Church Diocese of Lismore. At the time, the-aged care operator had $34.7 million “cash on hand” and had received $3.1 million in federal JobKeeper funds.


The funding proposal that went to the ERC was blunt in its assessment of the project. Under the heading “risks, sensitivities and any other issues”, Treasury officials wrote that the grant was “not supported”.


The document prepared for the review committee said: “The proposal provides financial support for the establishment of a private residential aged-care facility. Given funding and regulation of aged care is a matter for the Commonwealth government, and the benefits accrue to the private residents and operator of the facility, the need for government support is unclear.”


As it happens, the decision had already been made. Hours before the ERC meeting actually took place, public servants were given the job of writing a press release for the announcement.


A week later, on October 27, 2020, Berejiklian was in Port Macquarie posing for a ceremonial sod-turning at the development site next to newly minted Liberal MP Leslie Williams. The official press release, now absent from the NSW government directory but still hosted by Williams on her MP website, includes quotes from the then premier and her treasurer.


Port Macquarie has one of the highest prevalence rates of dementia in NSW and this state-of-the-art facility will offer transformational care for the elderly,” Berejiklian said.


And from Perrottet: “We expect this unique project, which is a NSW first, to create hundreds of jobs in the health, building and construction industries on the mid-North Coast.


What is clear from the time line of events is that the government, with negotiations handled out of the then treasurer’s office, moved quickly to rush through the $5 million in funding. This raised eyebrows internally.


The aged-care sector is poised to grow substantially in NSW, contributing to jobs growth and the economy but as Covid events have shown us, quality of care is paramount.”


The ERC brief from Treasury did not put a figure on the jobs created, noting only that it was “TBD” or “to be disclosed”.


Williams, naturally, was thrilled. At the time, she said: “The NSW government’s investment will help build the community centre in the village, which houses all the social amenities that make this facility unique.”


St Agnes’ Care and Lifestyle chief executive Adam Spencer remarked that “both Ms Williams and the premier have been very supportive of this project”…..

Australian Prime Minister Scott Morrison has ordered an urgent review of the 42 year old National Australia Day Council


On 1 May 2021 The Saturday Paper reported that Australian Prime Minister Scott Morrison has ordered an urgent review of the board of the National Australia Day Council, established as the Australia Day Committee in 1979. 


National Australia Day Council Limited (NADC) is a not-for-profit Commonwealth owned corporation, within the Prime Minister's portfolio responsibilities, as well as being a tax exempt charity which is the “coordinating body for Australia Day celebrations across the nation and for the Australian of the Year Awards. The NADC heads a network of eight state and territory Australia Day affiliate organisations and 780 local Australia Day committees….reports to the Commonwealth Parliament under the provisions of the Public Governance, Performance and Accountability Act 2013. The operations of the company are overseen by a board of Directors appointed by the Prime Minister”.

As of 1 May 2021 the position of Chair, Deputy Chair, and two Director/Non Executive Director positions are vacant. Danielle Roche and Maurie McNarn are no longer on the board. Robbie Sefton is no longer Deputy Chair but remains a Director/Non Executive Director and Alison Page became a board member in September 2020.


NADC employs around 12 people full-time and is located in Canberra, ACT.


In its last published annual report NADC stated that:


During the period ended 30 June 2020, the NADC and Network continued to deliver both national and state programs. The Australian Government, through the Department of the Prime Minister and Cabinet, provided a total of $14,665,913 funding for the company. Sponsors provided a total of $2,109,860 for national programs, and part of this funding was allocated to state and territory Australia Day affiliates for local projects.


NADC does not appear to have any significant debt. There appears to have been no ministerial directions received, no government policy orders received and no judicial decisions or decisions of administrative tribunals were made concerning NADC during the 2019-20 reporting period.


So what has made the Prime Minister hot under the collar? After all, he makes those NADC board appointments.


Could it be that Morrison is uncomfortable with the fact that from January 2020 NADC through its “The Story of Australia” advertising placed a much greater emphasis on the histories and stories of Aboriginal and Torres Strait Islander people? That he didn't like the NADC commitment for 2020-21 to "work to expand the reach of our Respect, Reflect, Celebrate: We’re all part of the story message into Australia Day events in every State and Territory, every town and city"?


Or was he incensed to the core of his narrow, historically inaccurate world view by this event?


"At dawn on Australia Day 2020, Port Phillip City Council in Melbourne and the Boonwurrung Land and Sea Council, with the support of the NADC, held a We-Akon Dilinja (Mourning-Reflection) ceremony."


Chronologically it seems that Morrison's unusually short extension of Danielle Roche's contact as a NADOC director, which saw her ending her association with the National Australia Day Council on 31 March 2021, possibly may have followed on from his personal dissatisfaction with the 2020 Respect, Reflect, Celebrate Australia Day message which acknowledged Aboriginal dispossession commencing in 1788.  Within four weeks of becoming prime minister Scott Morrison in 2018 was on record as viewing any such acknowledgement as "indulgent self loathing".


Or is it that in 2021 NADC made Grace Tame @TamePunk Australian of the Year and she refused be cowed by his ‘eminent’ position or pull her punches when it came to publicly speaking of institutional sexual abuse, sexual assault and sexual harassment


Or is Morrison upset that on 25 January 2021 the NADC Board made a referral to the Australian Criminal Intelligence Commission (ACIC) of the leak of some Australia Day award recipients' names, given strong suspicions that there was an attempt by a person or persons to manipulate the betting market? For operational reasons about 180 individuals were informed of the winners names in December 2020 and that possibly would have included one or more staff in the Office of Prime Minster and Cabinet. No award finalists are ever informed before the official announcement on 26 January.

Nationals MP for Clarence is jumping up and down about the Clarence Valley being left out of the NSW-Qld border bubble. Well the fact of the matter is that the O'Farrell-Baird-Berejilkian Government has had 9 years to reverse the error that led to the current problem & neither he, his party or the government have addressed the issue

 

Sometime in the 21st Century the New South Wales Government invited a bee into its bonnet concerning a need to amalgamate regional local government areas with a view to eventually creating mega-councils and, when that policy was not greeted with enthusiasm (indeed sometimes with open rebellion) it decided to create communities of interest containing clusters of local government areas 'sharing' resources.

Down in Sydney - somewhere between Macquarie Street and Macquarie Towers - the state government decided to overturn the genuine Northern Rivers community of interest built up over the last 179 years and reclassify the Clarence Valley as "Mid-North Coast"

Although many in the Clarence Valley fought back against being lumped in with 'southerners' who did not share a good many of our values, aspirations or concerns, the state government kept insisting.

By 2006 only the Australian Bureau of Meteorology consistently referred to the Clarence Valley as being in the Northern Rivers region and much later the valley was included with the other historical Northern Rivers areas in the one state health district.

When it came to NSW Government agencies generally, they tended to gather data about the Clarence Valley, its communities and residents as part of the newly defined "Mid-North Coast".

We were frequently merged with Coffs Harbour when it came to recording crime, unemployment  levels, transport infrastructure and, at a regional planning level we were lumped with Coffs Harbour, Belligen, Nambucca, Kempsey, Port Macquarie-Hastings, Greater Taree and Great Lakes local government areas. 

Now the National Party members of the O'Farrel-Baird-Berejiklian Government were well aware of the fact that Clarence Valley communities never considered the reclassification was anything but a political move by a city-centric government and were instinctively refusing to turn their eyes south.

However, I do not recall any individual or combined push by Chris Gulapatis, Geoff Provest or Ben Franklin to reverse that "Mid-North Coast" label before the global pandemic intruded into the state.

So it should not come as a surprise that when the Queensland Government began to look for information about where the Clarence Valley was both geographically and socially when considering its response to COVID-19, it found us in what appeared to be a large population cluster which was too close for comfort to the outer fringes of heavily populated areas like the Hunter-Newcastle and Central Coast.

Former surveyor Chris Gulaptis can go to the newspapers calling the Clarence Valley's exclusion from the Northern Rivers border bubble "ridiculous", "bizarre, perplexing and unnecessary" but he has sat on his hands for almost nine years happily ignoring what locals had been telling him during those years - that the time would come when we would all rue the day that the NSW Government on paper ejected us from the Northern Rivers.

A few facts about the NSW Minerals Council and how it operates as an industry lobbyist in 2019


Stephen John Galilee is currently Chief Executive Officer (CEO) of the NSW Minerals Council, a private sector lobby group for the mining industry with less than 100 members – not all of which are directly engaged in mining activities.

The council conducts public and policy advocacy on behalf of the mining sector, with a staff of 15 full-time equivalent employees – 6 of whom are primarily engaged in work on policy and 5 or 6 engaged in public advocacy, communications & media activity.

Stephen Galilee’s previous employment was as chief of staff to then Liberal MP for Manly Mike Baird when he was Treasurer in the O’Farrell Coalition Government and, before that he was employed as chief of staff to Liberal MP for Groom Ian Mcfarlane when he was Minister for Industry, Tourism and Resources.

On 21 October Galilee gave evidence under oath before a NSW Independent Commission Against Corruption inquiry into lobbying practises in this state.

During his evidence Galilee confirmed that the NSW Minerals Council:
  • income is derived from annual membership fees which are set at a percentage or proportion of the value of members commodity production;
  • annual revenue is between est. $4 million to $8 million;
  • is an associate member of the Minerals Council of Australia;
  • meets with government officials “on a regular basis” and such meeting are sometimes with government ministers;
  • probably has face-to-face meetings with between four or five individual ministers at some point during the year which include council policy directors and/or the CEO;
  • has a “regular engagement with the Deputy Premier in his capacity as Minister for Resources”;
  • requests to see ministers are generally submitted by letter to their chiefs of staff (with reasons given), then followed up with a ‘phone call;
  • shadow ministers are also lobbied on occasion;
  • CEO has met with between 8 and 10 NSW Government ministers over the last 2 to 3 years and with 10 to 15 ministerial chiefs of staff. These often involve follow up meetings with ministers' offices, departments or specific policy personnel;
  • meets with the Resources Regulator and Environmental Protection Authority “every couple of months” and with the Dept of Planning’s Division of Resources and Geoscience “every two or three months”;
  • in the past four years has made “around 150 public submissions in response to government proposals for changes to legislation, policy or regulations”;
  • at the moment is regularly engaging with the Department of Planning concerning planning system issues, in particular provisions in the Environmental Planning & Assessment Act;
  • does not use the official form required since 2017 to request meetings with the Dept. of Planning;
  • has meetings with the Dept. of Planning which are not minuted;
  • CEO does not keep records of meeting he attends - often his record comprises only diary entry of meeting date and "three dot points on a piece of paper" to aid memory;
  • current focus in relation to policy advocacy regarding planning system issues is to reduce financial risk for mining/commodity investors which has been spurred on by United Wambo determination, Bylong Project decision and actions of the Independent Planning Commission;
  • is currently "running a public campaign against the Planning Minister and his planning system".
  • states that the government departments “take a lot of industry money to deliver services for us. So we like to make sure those services are being delivered...”; and
  • holds "a lot of functions and events for the industry and we invite local MPs, for example, to attend and ministers and shadow ministers from time to time come along to our functions and events".

The NSW Department of Planning, Industry and Environment apparently considers the NSW Minerals Council an organisation containing 'inhouse' lobbyists not a third party lobbyist and therefore doesn't record contact with this group in its Lobbyist Contact Register to date.

Based on the evidence given  on 21 October, it is possible that there may have been times when no other person has been present at a meeting between a NSW Minister and the NSW Minerals Council.

It is also clear from the evidence that the NSW Minerals Council would be unhappy with any new legislation or regulations requiring a greater degree of transparency with regard to its lobbying activities.

At the same time the NSW Minerals Council does not appear to always trust that public officials and public authorities make decisions on cogent evidence in a balanced, detached, informative way - blaming public interest advocacy and "noisy objectors" for what it perceives as skewing outcomes.

As it now stands the NSW Minerals Council as a lobbyist group seems to be minimally regulated with regard to its activities.

Reef destroying cruise ship given NSW Government permission to enter the Clarence River in October 2018


This was the NSW Berejiklian Government in roll-over-the-top-of-Clarence-River-Estuary-communities mode, courtesy of Nationals MP Andrew Fraser and Minister for Roads, Maritime and Freight Melinda Pavey with the Minister for Transport and Infrastructure Andrew Constance in an October 2017 media release:


An investigation into a new International Cruise Ship Terminal for the NSW mid North Coast will start as part of a future transport blueprint, with Coffs Harbour and Yamba identified as potential locations.

Minister for Roads, Maritime and Freight Melinda Pavey, Minister for Transport and Infrastructure Andrew Constance, alongside Member for Coffs Harbour Andrew Fraser announced the start of investigations as part of the launch of the government’s Future Transport 2056 strategy.

“This is a major step, with the need for a facility being recognised in the 10 to 20 year horizon, so early investigations can begin now”, Mrs Pavey said.

The new facility has the potential to link in with North Coast tourist hotspots and part of the process will look at how to integrate the proposed port with the wider area.

“The Cruise Industry is booming and is set to get bigger in coming years. A cruise terminal would give the region a share of that industry,” Mr Constance said.

Future Transport 2056 is Transport for NSW’s new strategy to meet our transport needs over the coming four decades and is currently seeking community feedback.

“The strategy has a strong focus on regional NSW, with an emphasis on customer needs, better connectivity and growing regions,” Mr Fraser said.

What this does not say is that Future Transport 2056 only mentions Yamba twice.

The first time in the dot point sentence; Maritime infrastructure development (e.g. Coffs Harbour/Yamba).

The second time in another dot point one liner; Coffs Harbour / Yamba cruise terminal/ infrastructure development.

In a section titled Our Customers the draft plan makes the generic one sentence statement; Improve public transport connections to arrival and departure points such as airports and cruise terminals.
The media release talks of a need for “investigation” and a plan to consult with the community in Grafton – not downriver at the  two communities most affected, Yamba or Iluka.

Despite the claims that Yamba is only a “potential” location, Roads, Freight & Maritime Minister and Nationals MP for Oxley Melinda Pavey blithely announced in the Clarence Valley Independent that the first cruise ship will moor in the Clarence River estuary in October next year:

The NSW Tourism plan outlines a commitment to a Cruise Development Plan over the next 10 years to develop the state’s tourist economy into the future,” Ms Pavey’s office wrote in an emailed response.

“The plan identifies the North Coast as being the most visited regional destination in NSW and the cruise industry offers further opportunities to strengthen that.

“There is considerable interest across industry and community in using the North Coast of NSW as a place for ships to berth.

“In fact, operators are already beginning to look at destinations such as Yamba for smaller cruise vessels. “

On this, Ms Pavey’s office said: “In October 2018, the Cruise Ship Caledonian Sky plans to stop off at Yamba as part of the Australian Coastal Odyssey.”

This will be the small cruise ship Caledonian Sky, a 26 year-old 90m long vessel which has seen better days, with a carrying capacity of 114 passengers.


What Minister Pavey was careful not to point out is that this same small cruise ship ran aground and smashed a wide area of pristine coral reef in Raja Ampat, Indonesian Papua, in March 2017, with the damage area extending 18,882 sq. metres. The majority of this area being heavily damaged and even reefs receiving medium damage only having a 50% chance of survival .

The situation was allegedly made even worse when a tugboat helped pull the vessel to deeper waters.

According to Rappler.com, 14 March 2017:

"JAKARTA, Indonesia (UPDATED) —The government of Indonesia had harsh words for the captain of cruise vessel MV Caledonian Sky, which was responsible for destroying a huge amount of coral reefs in Raja Ampat, Papua.

The damage by Caledonian Sky which was captained by Keith Michael Taylor was devastating and irreparable," said a statement from Djoko Hartoyo of the Information and Law Bureau of the Coordinating Ministry for Maritime Affairs, released on Tuesday, March 14.

"The destruction of Raja Ampat coral reefs which were developed by nature for hundreds of years was done in less than one day by Caledonian Sky and its Captain. It is simply impossible to restore that part of Raja Ampat. Fish that were normally seen in that particular were all gone."

The statement then went on to suggest that Taylor cared little about the destruction he inflicted.

Melinda Pavey’s desire to keep this incident under wraps comes as no surprise, given that this cruise ship would have to navigate a relatively narrow passage past the culturally significant coffee rock reef, Dirragun, which is now covered by Native Title.

Perhaps it is time for concerned Lower Clarence residents to start contacting the minister in order to express their views on her grand plans for the Port of Yamba at:

Talking of visitors, we turn to the good folk of the cruise ship Caledonian Sky and their Wednesday visit to New Plymouth. A smartly dressed reporter at this paper had the gumption to approach a pair of these travellers to see what they thought of the city. It didn't quite go according to plan, with the English pair mistaking him for a hawker and rudely demanding identification. Come now, chaps, the reporter didn't ask you for identification. Mind you, it was obvious you were from a cruise ship. The expansive waistlines, white walk socks and boorish behaviour gave it away.

TROBRIAND Islanders have threatened to "block or disrupt" future visits by tourists to protest the alleged dumping of rubbish by cruise ship.

Kudeuli and Wapaya villagers on the island of Kitava, which is part of the famed Trobriand Islands group, have alleged that the cruise ship MV Caledonian Sky dumped bags of rubbish on their beaches after a recent visit.

The villagers took pictures of empty bottles of wine, can drinks and plastic bags which they alleged were dropped off by five dinghies not far from their villages. The rubbish eventually washed up on their beaches while heavy items sank to the bottom of the ocean, the islanders claimed.

Coordinating Maritime Affairs Minister Luhut Binsar Pandjaitan has said the captain of UK cruise vessel MV Caledonian Sky, which recently ran aground in Raja Ampat, West Papua, had previously made a similar mistake, in which his vessel entered shallow waters in Medan, North Sumatra, destroying sea biota in the area.
“We have data on the ship captain’s mistake in Medan,” said Luhut on Thursday.

Yamba Mega Port Proposal: "This clown just won't take no for an answer"


"This clown just won't take no for an answer" would be a fairly accurate assessment of most Lower Clarence River residents’ opinion of Desmond Euen’s (pictured left) latest attempt to promote his proposal to industrialise the Clarence River estuary by re-creating the Port of Yamba as a mega port.

Having been told repeatedly by local communities that his proposal was unwelcome and, by local government and the NSW Baird Government that the proposal would not be supported/endorsed, he still persists.

In August this year Mr. Euen participated in the following inquiry via the submission process.


On 24 November 2016, the Australian Government announced it will develop a national freight and supply chain strategy (the strategy) to increase the productivity and efficiency of Australia's freight supply chain. The strategy is in response to Infrastructure Australia's Australian Infrastructure Plan.

On 9 March 2017, the Minister for Infrastructure and Transport, the Hon Darren Chester MP, released Terms of Reference PDF: 219 KB  for an inquiry into National Freight and Supply Chain Priorities (the inquiry).

The Inquiry will inform the development of the strategy and determine how to best lift the productivity and efficiency of Australia's freight supply chain. The inquiry is being led by the Department assisted by Infrastructure Australia and a four member Expert Panel appointed by Minister Chester. On 26 May 2017, the Department released the Discussion Paper for the inquiry, marking the commencement of the public consultation period. Submissions closed on 28 July 2017 and the Department is now analysing the responses, together with comments received from meetings with key stakeholders.

A draft report will be made available for industry and government for comment by December, and the final report provided to the Government by March 2018.

As Inter-Port Global Pty Ltd he submitted two documents (Submission 27 in above link) – one of which was for Gladstone Strategic Development Area in Queensland and the other for the Port of Yamba on the NSW North Coast.
                               
The 42-page Yamba document was originally created by Euen on 27 July 2017 according to its “Properties” page. It asserts to be a submission originally made to Infrastructure Australia at an earlier date.

Desmond Euen of Unit 1103, 2865 Gold Coast Highway, SURFERS PARADISE QLD 4217 registered Inter-Port Global Pty Ltd on 24 August 2016. To date he is the sole director and shareholder as well as the company secretary.

There were a number of confidential submissions to the Inquiry into National Freight and Supply Chain Priorities and it is possible that one of these may be from the group of corporate lawyers, investment companies and property developers behind United Land Councils Ltd and United First Peoples Syndications Pty Ltd who made a joint submission to the NSW Legislative Council General Purpose Standing Committee No. 6 Inquiry Into Crown Land in August 2016 which included the Yamba mega port proposal .

The Inquiry into National Freight and Supply Chain Priorities is due to hand its report to the COAG Transport and Infrastructure Council sometime before end March 2018.
