The Perrottet Coalition Government just won't give up on a bad tourism idea for the Clarence River estuary


North Coast Voices readers may recall that in March 2017 Lower Clarence River communities became aware that Liberal MLA for Willoughby and NSW Premier Gladys Berejiklian and members of her Cabinet were considering expanding the uses that the Clarence River estuary and the Port of Yamba could be put to.


By November of that year it had firmed into future plans for Yamba to become a cruise ship port and destination with a waterborne trojan horse to be delivered into the estuary in October 2018.


The Yamba and Iluka communities were not amused by both the NSW Government's plans and its lack of consultation.


These communities got loud. The Berejiklian Government went quiet and the named international cruise ship company decided to bypass the Port of Yamba. 


There appeared to have been no specific development activities in 2019 or in 2020 when the global pandemic reached Australia.


However, this was, and under Liberal MP for Epping NSW Premier Dominic Perrott still is, a government which doesn't like taking a decided "No" for an answer.


So this is still appearing on a current tourism website set up under the auspices of the NSW Government.

I am one Yamba resident who is really incensed that these wealthy, self-entitled #COVIDIOTS placed my community at risk


I suspect that I am not the only Clarence Valley resident disturbed by this breach of COVID-19 public health orders.

Like others I am wondering why the Port Of Yamba, a first point of entry for vessels and certain goods, as determined under subsection 229(1) of the Biosecurity Act 2015 (Cth), a) did not restrict the "Lady Pamela" to an overnight only mooring within the formal limits of the port and prohibit crew or passengers from leaving the confines of the yacht or b) if mooring was for longer than overnight did not require passengers & crew to be tested for the virus.

Melbourne millionaire Mark Simonds and his family face a two-week stay in hotel lockdown after the Queensland government revoked a quarantine exemption for their super-yacht Lady Pamela. 

The Age and The Sydney Morning Herald, in a joint investigation with A Current Affair, revealed the 30-metre vessel docked on the Gold Coast on Monday morning after slipping out of Melbourne on August 9 and stopping on at least five occasions as it sailed up the east coast. 

Mr Simonds, executive director of the ASX-listed Simonds Group, was joined on his 15-day jaunt by his wife, Cheryl, his youngest son Vallence and Hannah Fox, daughter of Linfox executive chairman Peter Fox. 

The Queensland government granted an exemption to the Lady Pamela on Sunday night to enter the state but on Tuesday afternoon that exemption was revoked after Queensland Health said it had received new information. 

"All seven people are now required to quarantine in a government-approved hotel for 14 days at their own expense," a Queensland Health spokesperson said. 

"Attempting to bypass or manipulate Queensland's border direction is unacceptable." Queensland Police had been provided with video evidence by A Current Affair, which revealed passengers and crew disembarking from the Lady Pamela in Yamba on August 21, which is understood to have breached the conditions of their exemption. 

The group, which also includes several crew members, were removed from the Lady Pamela by members of Queensland Police just before 7pm on Tuesday evening, before they boarded a mini-van.....

Since last Wednesday, the boat had been moored in an inlet in Yamba, on the NSW north coast, where the Simonds family were seen swimming in the Clarence River and drinking on deck, while a crew member was dispatched to bring supplies.

A new year brings old threats to the Clarence River estuary and communities along its banks


Preoccupied with major fire activity since September 2019, it was easy to miss this renewal of cruise industry pressure.....

On 4 October 2019 cruisepassenger.com.au published an article titled 
"FIVE SECRET AUSSIE PORTS YOU’LL BE SOON BE SAILING TO".

This is an extract from that article which will be of considerable interest to communities with environmental, cultural and economic concerns about cruise ships seeking entry into the Clarence River.

"Mayor Cr. Jim Simmons says “We can see a lot of economic benefits for the area…but so far we have had some community angst around the idea and that stems from our experience with large ships in the past. Our concerns are purely environmental concerns, but if that’s all covered, then the community may be very positive.

“Many years ago we had the big timber ships and large vessels coming into the sugar mill – but so far we haven’t had large passenger cruise ships,” Cr. Simmons added.

“If the ships are moored offshore, with passengers tendered in on smaller boats and all of the measures are put in place to protect the ocean environment then this would be something great for Yamba.”

The Clarence Valley mayor has obviously drunk the cruise industry Kool-Aid, if he seriously believes that cruise ships will make any significant contribution to the economies of Yamba, Iluka or Maclean.

There is enough evidence to the contrary coming from cities and towns around the world that have become cruise destinations. Specifically the fact that cruise lines inflate projections of the spending capacity of their passengers which are rarely realised, as a matter of company policy tend to poorly pay local tourism operators for services, charge local businesses a fee for inclusion in ship brochures, seek significant concessions on port fees and cruise ship activity generally tends to depress land-based tourism over time. As for his suggestion of mooring offshore - there is no sheltered coastline near the mouth of the Clarence River to make disembarking or boarding a cruise ship reliably risk free for passengers.

While characterising community concerns as being "purely environmental", this is a simplistic explanation given a significant Yaegl cultural/spiritual site held under Native Title lies across the entrance to the Clarence River.

Clarence Valley 2019: keeping the Clarence River Estuary healthy for future generations

“Shipyards are dangerous construction zones with many worker hazards. Shipbuilding, repair, cleaning, and coating use toxic chemicals and hazardous or flammable materials. These activities also can pollute water directly or through runoff. Repairs may require emptying dirty water from a ship’s ballast and bilge tanks into the surrounding waters….. Shipbuilding and ship repair use toxic chemicals that include chromium, copper, lead, and nickel. Ship cleaning activities use chemicals that include copper, hazardous or flammable materials, heavy metals, and solvents. If it wasn’t bad enough that barely two years ago Lower Clarence communities still had a flimflam man and then a set of dodgy companies (mentioned in a NSW Independent Commission Against Corruption investigation in 2018) trying to push for large scale industrialisation of Clarence River estuary – now Clarence Valley Council apparently attracted by the lure of vacant crown land up for grabs appears to be joining the push to industrialise-and-be-damned if these little gems in its “Clarence Valley Regional Economic Development Strategy 2018 -2022” are any indication.

These are excerpts from that document:

Clarence Valley’s key endowments lie in its coastal, riverine and hinterland amenity; arable soils and favourable climate; access to Sydney and Brisbane via the Pacific Highway; and the ability to bring new industrial land to market cost effectively…..

Industrial Land -The Clarence Valley has seven industrial estates open for business and far more potential development sites compared with neighbouring councils…..

Sustaining a ready supply of zoned and serviced industrial land is a strategic priority for supporting growth in these specialisations, with marine precinct proposals……

•Meet emerging industrial land use opportunities in a timely way •Develop a marine precinct proposal •Develop a project portfolio of enabling infrastructure for industrial sites, including the marine precinct proposal…..•Develop a Port of Yamba Strategy…….

The Clarence River estuary covers an 800 sq. kilometres floodplain and key environmental indicators for this estuary’s health include water quality, riverbank vegetation, the number and distribution of fish species, as well as the presence of macroinvertebrates and plankton.

The estuary is already beginning to struggle under the weight of human activity, including marine activity. A fact it would seem that Clarence Valley Council ignores in its development strategy.

It is a fact that estuary communities cannot afford to ignore if they wish to preserve the aesthetic, cultural, social and environmental amenity which supports both community life and the local economy.

In 2016-2017 a study of six NSW ports was undertaken and published in PLoS One and online in December 2017 as “Water quality assessment of Australian ports using water quality evaluation indices”.

With regard to the Port of Yamba in the lower Clarence estuary the study recommended regular monitoring and management of port activities accounting for both biological and chemical toxicological profiles of the discharging activities.

It did so for the following reasons:

* The Port of Yamba has standard levels of Dissolved Oxygen according to ANZECC guidelines. However. the amount of fecal coliforms was significantly higher in the water of the port area than the corresponding background samples, which clearly indicates the impact of the fishing fleet and recreational boating on the port environment.

* Very high concentrations of iron were found in the port water, the maximum concentration of lead in the water exceeded the ANZECC (0.0022) guidelines with all the background samples had much lower concentration of lead compared to the port area and, the maximum concentration of copper in the water was much higher than ANZECC guidelines and exceeded other international guidelines at (0.04 mg/l) in Port of Yamba.

* The mean concentration of copper also exceeded the ANZECC guidelines. When it came to zinc levels were low except in the port area which contained very high concentrations of zinc, which exceeded the guidelines. Concentration of cadmium and cobalt were within the ANZECC guidelines.

* Overall the Port of Yamba portrayed high contamination for all standard guidelines when it came to water quality – the port area has water quality of medium contamination and one site has high contamination.

Clarence Valley Council itself admits that the entire estuary is already under stress in its Report Card 2013:

“Water quality was poor in the estuary throughout the study, with the region around the tidal limit with consistently the worst water quality of the Clarence River 
reflecting the freshwater and tidal inputs at these sites. Estuary tributaries, particularly Swan and Sportsmans Creeks and the Coldstream River were in very
poor overall condition receiving a grade of F. These systems had consistently poor water quality that contributed nutrient rich, low oxygen and acid water
to the Clarence River following flooding.

Concentrations of nitrogen and phosphorus consistently exceeded the guideline values throughout the study at all sites. Very high nitrogen concentrations were
recorded in estuarine reaches following flooding. There were no algal blooms recorded during the study. However, algal concentrations were consistently
above the guideline value in estuarine reaches.

The Broadwater and Wooloweyah coastal lagoons both had very poor water quality, with high algal and nutrient concentrations and turbidity, and low dissolved oxygen values consistently exceeding a number of water quality guidelines. The Broadwater had better riparian condition relative to Wooloweyah that improved its overall grade.

Riparian condition was generally low from a poor diversity of native vegetation, reduced vegetation structure and small isolated pockets that were poorly connected to other native vegetation. Reaches showed evidence of eroding river banks and sediment deposited in the channel. Estuarine reaches were often dominated by riverbanks with little or no vegetation present, leading to very poor condition grades.”

The tidal water exchange will not protect the lower estuary from a spreading loss of water quality and increased levels of pollution once industry begins to expand along its foreshores and clusters of marine businesses such as shipbuilding and repair are further developed. 

There will be a tipping point that once reached will be hard, perhaps even impossible, to reverse.

This is something that Lower Clarence communities need to consider before council goes too far down this path which leads away from a healthy estuary for future generations.

Clarence River Estuary communities need to remain both alert and alarmed as NSW Berejiklian Government seeks to expand exposure to international cruise ship industry


In July 2018 the NSW Berejiklian Coalition Government released the document “NSW Cruise Development Plan” to the delight of the international cruise ship industry.

This plan confirms that Berejiklian ministry - sitting in offices over 670kms south of the small towns of Yamba and Iluka on the banks of the Clarence River estuary - is still pursuing the idea that the Port of Yamba is a potential official cruise ship destination.

The state government also obviously expects that Clarence Valley local government will both accommodate the needs of the plan and contribute to the cost of meeting this aim if it is progressed.

To further the Berejiklian Government’s aim to make as many small ports or undeveloped harbours/inlets capable of use by cruise ships the NSW Cruise Development Plan states that:

A regulatory framework that fosters the competitiveness of ports, encourages the expansion of the tourism sector, minimises environmental impacts, protects the community, and supports jobs growth is required for the NSW cruise industry.
National regulatory barriers currently inhibit the cruise industry, including the small expedition and luxury cruise market’s, access to NSW coastal ports.

Differences in regulatory requirements between states also restricts the freedom of cruise liners to set national itineraries that take advantage of regional ports.
The NSW Government will continue to lead discussions with the other States, Territories and the Commonwealth on removing regulatory barriers that limit cruise ship growth potential.

Action: The NSW Government will investigate opportunities to remove regulatory barriers to entry for emerging cruise markets, including the expedition cruise market, and will seek an inter-jurisdictional policy position with other governments. [my yellow highlighting]

What the Liberal-Nationals government in faraway Sydney considers as “regulatory barriers” may not be what the people of the Lower Clarence River consider as impediments which should be removed.


They are in place for good reason and any weakening of these regulations has the potential to affect the environmental sustainability of an ancient, healthy and highly productive estuary system which is the largest in south-east Australia and, whose waters are covered by Yaegl Native Title.

Facts estuary communities may need to continually press upon a state government wrapped up as it is in a cosy relationship with the international cruise ship industry.

One of the reasons why local government, traditional owners and communities in the Clarence Valley should be very wary of home-grown and foreign lobbyists, investment consortiums and land developers – Part Three


In July 2018 the NSW Independent Commission Against Corruption (ICAC) continues to hear evidence in Operation Skyline.

An organisation called United Land Councils Limited was mentioned as allegedly sending its then sole director Richard Green around New South Wales to talk with local aboriginal land councils concerning certain proposals.

These trips appear to have commenced sometime in 2015.

At least one trip taken in 2016 by Mr. Green was to Yamba in the Clarence Valley, allegedly at the behest of Nicholas Petroulias.

The subject of the alleged discussion/s with the Yaegl community in Yamba was the creation of a large port in the Clarence River estuary.

It shoud be noted that by July 2016 Yaegl elders and the Yaegl Traditional Owners Aboriginal Corporation were strongly opposed to a mega port being created in the estuary.

The Daily Telegraph, 13 July 2018:

AUSTRALIA’S youngest ever tax chief is behind bars after ­allegedly being caught with a wallet full of counterfeit cash, bank cards in different names and dodgy driver’s licences.

Nick Petroulias, once the nation’s second most powerful tax official, appeared before Burwood Local Court as Michael Nicholas Felson earlier this week having been pulled over by police while driving his luxury black BMW X5.

When the officers stopped him in inner-west Sydney on June 20, the 50-year-old is alleged to have handed them a current New Zealand driver’s licence in the name of another alias, Nicholas James Piers.

Police will allege that inquiries revealed Piers was a permanent resident of Australia and allegedly had a number of aliases including Nick Petersen, Michael Felson as well as his real name — Nick Petroulias.

Under his various aliases he is alleged to have held one NSW driver’s licence, three Queensland licences, one from Victoria and another from Tasmania, only two of which were current. He has not been charged over those licences.

Once a Melbourne legal whiz-kid, Petroulias (pictured left) was made assistant commissioner of the Australian Taxation Office at the age of 30. In 2014 he was declared bankrupt with eye-watering estimated debts of $104 million.

On Tuesday he appeared in court via videolink from Silverwater Jail dressed in prison greens as he used his fingers to flatten the “comb-over” hiding his bald head.

Court documents show he has pleaded not guilty to knowingly possessing seven counterfeit Australian $50 bank notes and two counts of possessing bank cards with the intention of committing fraud. He was refused police bail on June 20 and refused bail in Burwood Local Court the next day.

His case has been adjourned to August 14 when the court was told he will make a fresh bail application.

Newcastle Herald, 17 July 2018:

A member of the Awabakal Local Aboriginal Land Council has admitted to giving false evidence to the Independent Commission against Corruption and disobeying orders not to discuss its inquiry with other potential witnesses, after an intercepted phone call was played in which he told former tax official Nick Petroulias about an inquiry into land deals with which the pair were involved.

But Richard Green, former deputy chair of Awabakal, denied he was “tipping off” Mr Petroulias about the ICAC inquiry.

He was reprimanded by Commissioner Peter Hall QC for failing to answer questions directly.

“Mr Green if you're going to obstruct this commission you could be putting yourself into real trouble,” Commissioner Hall said.

On Monday, Mr Green was questioned about whether he spoke to anyone after receiving a summons from the ICAC in January, telling him he would be required to appear before its Operation Skyline public hearings and warning him not to discuss the matter with any other person.

When pressed by counsel assisting the commission, Nicholas Chen SC, Mr Green admitted he had a brief conversation with Mr Petroulias about the summons, but said it was because he had not read the warning contained within the letter.

However minutes later, a phone intercept was played where Mr Green was heard to read the contents of the letter to Mr Petroulias, including the direction to keep the summons confidential.

“That was contrary to the clear and express statement of what you were not permitted to do. Isn't that right?” Mr Chen said. “What's your excuse, Mr Green, for doing that?”

“Like I said before I don't – I haven't got an excuse,” Mr Green responded.

The inquiry heard that Mr Petroulias is in custody on unrelated charges. 

The former tax office high flyer is accused of playing a "central role" in four deals to sell off Awabakal land. The ICAC is investigating whether the deals were a sham to benefit Mr Petroulias, his lawyer partner Despina Bakis, and Awabakal board members Mr Green and Debbie Dates.

Mr Green conceded that his signature appeared on a number of the sales agreements. However he insisted he could not read well and had not read through documents when they were given to him to sign by either Mr Petroulias or Ms Bakis.
He could not explain why he signed the documents without telling other board members about them, despite board approval being a requirement of land sales. He agreed his behaviour was "reckless in the extreme" but denied he benefited financially from it.

"When you've got a person acting like Nick you take notice of them," he said. "And I keep saying over and over if people understand how Aboriginal land councils function they will understand what I'm talking about.''

Newcastle Herald, 19 July 2018:

Luxury cars, gold jewellery, and Foxtel subscriptions were among the items that Richard Green bought with money disgraced former assistant tax commissioner Nick Petroulias provided to him, allegedly for helping facilitate the sale of Aboriginal-owned land in the Lower Hunter.  

The Independent Commission Against Corruption heard on Wednesday that Mr Green, a former land council board member, is alleged to have received an estimated $145,000 between 2014 and 2016 for his personal benefit from Mr Petroulias. 

The money was received via several bank and credit card accounts that were operated in Mr Green’s name, but which appear to have been opened on behalf of him by Mr Petroulias. 

Mr Green appeared confused when presented with statements from some of the accounts and denied any prior knowledge of others. 

The commission is investigating whether a series of deals to sell Awabakal land to developers were a “ruse” to benefit former board members Richard Green or Debbie Dates.

It is also probing whether the first of the deals was a sham set up by Mr Petroulias – using a company he allegedly controlled called Gows Heat – so he could on-sell his interests to other buyers.

Noble Caledonia Limited changes its mind about Port of Yamba-Clarence River?

Noble Caledonia Limited’s “Australian Coastal Odyssey” twenty-two day cruise from 9-31 October 2018 - flying from London to Cairns to Port Moresby, then sailing through the Torres Strait and down the east coast of Australia to berth in Melbourne before returning home on 31 October - is still being advertised online and it just got a lot cheaper.

In an apparent effort to fill cabins aboard the vessel MV Caledonian Sky, the UK-based cruise line is now offering across-the-board discounts of £1,000 per two-person cabin.

There has also been a change in the ship’s itinerary for Day 16 - 24 October this year.

All mention of entry into Port of Yamba-Clarence River was removed from the cruise line's website sometime between 21 and 27 May and, Trial Bay, South West Rocks inserted instead for both its October 2018 “Australian Coastal Odyssey” and October 2019 “Australian Coastal Discovery” east coast cruises.
Caledonian Sky has already booked port berths/moorings in Queensland and Victoria as well as for two of the six official ports along the NSW leg of the 2018 cruise – Port of Newcastle (7am 25 October) and Port of Eden (7am 27 October). There is no published booking for Port of Yamba which requires piloted entry for sea-going ships.

Which has set Lower Clarence residents to wondering about the reasons for this welcome change of plan.

Some think it may be a public relations feint by Noble Caledonia to dampen expression of local concerns and it may yet decide to slip into the Clarence River estuary on or about 24 October this year.

Others point to the level of risk always associated with bringing ships like the 5-deck high, 91 metre long, est. 4,200 gross tonne Caledonian Sky across the entrance bar while avoiding collision with the culturally important Native Title reef “Dirrangun” and, the possibility that the cruise line’s insurance company might not be impressed if that risk were to be realised and it was faced with a second reef maritime incident in less than nineteen months involving the same ship.

Given the protracted negotiations between Noble Caledonia, its insurer and the Indonesian Government over a reported £350 million ‘fine’ incurred when the Caledonian Sky damaged over 18,000 sq. metres of pristine coral reef in the Raja Ampat island chain in March 2017, it is understandable that Noble Caledonia Limited may have reassessed the original “Australian Coastal Odyssey” itinerary and decided it preferred a less problematic short-stay mooring for Day 16.

Noble Caledonia Limited changes the 'spin' around its "Australian Coastal Odyssey" cruise and the Port 0f Yamba-Clarence River visit


It seems that Noble Caledonia Limited has decided to downgrade its description of the delights of Iluka and is trying to hide from locals the short amount of time MV Caledonian Sky passengers will be spending on land during the ship's brief stop over.

Is This The Clarence River Estuary Future If Berejiklian Government Has Its Way? "As the cruise season continues, smoke particles emitted from cruise ship funnels have left people living and working near the port increasingly alarmed"


Well the NSW Minister for Roads Maritime and Freight & Nationals MP for Oxley Melinda Pavey ended the fourth quarter of 2017 in much the same manner as she progressed through the three preceding quarters - she meet with representatives of international cruise lines.

I still didn't see any listed meeting with Yaegl native title representatives or with Clarence Valley Council in her published ministerial diary.

She certainly hasn't met with the communities of Yamba and Iluka which will be most affected by the 24/7 noise and fumes emanating from those cruise ships she is so eager to see make Port of Yamba-Clarence River a regular destination.

This is what happened in Hobart when it opened its doors to such cruise ships........

HOBART residents are continuing to suffer the effects of air pollution from visiting cruise ships, says Acting Lord Mayor Ron Christie.

As the cruise season continues, smoke particles emitted from cruise ship funnels have left people living and working near the port increasingly alarmed, Ald Christie said.

“This is a real public health concern,’’ he said.

“I have been taking calls recently, elderly residents… traders… they say they can smell it. One gentleman, says he gets asthma.” Ald Christie said with 59 ships scheduled to visit Hobart by the end of this season, and with greater numbers expected next season, the smoke issue needed to be brought to a head.

The council in September called on the Federal Government to force cruise ships to burn cleaner fuel while in Hobart, which was already a requirement for Sydney Harbour.

Some cruise ships can burn a cheaper low-grade fuel called bunker fuel, which emits sulphur dioxide, while in port.

A ban on fuel containing high levels of sulphur is due to begin in 2020. The State Government’s Environment Protection Authority has been monitoring air quality from an installation at CSIRO since last June.

An EPA statement said an interim report on the cruise ship season’s results would be published by the end of July.

“Monitoring at Hobart Port over this cruise ship season has seen ambient levels of sulphur dioxide well within national and international air quality standards.” the statement said.

The true nature of Noble Caledonian Limited?


One can tell a great deal about a corporation if one looks at when and how it was created.

The Noble Caledonia cruise line* likes to brag that it was created in 1991 out of a passion for small ships.

The company which created the cruise line was called Quayshelfco  382 Limited (incorporated 1 August 1991) before its name change to Noble Caledonia Limited registered on 30 October 1991 and, it has extremely long articles of association.

Noble Caledonia also likes to boast that; Being an independent company where the owners are involved in all aspects puts us in a unique place. From this position of freedom and not having to pander to shareholders and financial institutions....

In fact this company is owned by Noble Caledonia Holdings Limited which in turned is owned by its shareholders Arawak Travel Holdings Limited (formerly Arawak Capital Limited) and Cruising Investments (NC) Pty Ltd and, the ultimate controlling party is Polhavet AB a company registered in Sweden.  Noble Caledonia Limited is not always free of the need "to pander" to financial insitutions as the group appears to borrow large sums as required.
