Perhaps Australian Liberal Prime Minister, Scott Morrison, along with NSW Nationals Deputy Premier & Minister for Regional New South Wales, John Barilaro, might like to ask those 6,903 Northern NSW residents with a serious disability how they feel about their relegation to second-class citizenship in the middle of a global pandemic?

The disability royal commission says governments should not lift lockdowns until all people with disability have had the “opportunity to be fully vaccinated” – even if states and territories hit the 70% fully vaccinated threshold.


In a scathing draft report handed down on Monday morning, the royal commission found the federal department of health’s approach to vaccinating people with disabilities had been “seriously deficient”.


People with disability living in shared accommodation, or “group homes”, were included in phase 1a of the vaccine rollout but then quietly “deprioritised” in favour of aged care residents.


The commission is now concerned people with disabilities will remain unprotected as states such as New South Wales and Victoria look to ease restrictions when 70% of the adult population is fully vaccinated next month.


In our view, it would be grossly unfair, indeed unconscionable, if any people with disability who have not been given the opportunity to be fully vaccinated by the time the 70% threshold is reached are denied the freedoms available to people who have been fully vaccinated,” the report said.


The unfairness is magnified once it is accepted – as it must be – that increased freedoms for the fully vaccinated increase the risk of contracting Covid-19 for people who are not fully vaccinated.


It is one thing for people who choose not to be vaccinated to be denied these freedoms; it is quite another for people who have been denied the opportunity to be fully vaccinated also to be denied those freedoms.”


The report said the federal government should “use its best endeavours” to ensure no state or territory “significantly eases restrictions” when the 70% threshold is met unless all people with disability “have and appreciate that they have the opportunity to be fully vaccinated”.


The commission singled out national disability insurance scheme (NDIS) participants, people living in residential disability accommodation and people with intellectual disability as key groups. It said all active disability support workers should also be fully vaccinated before lockdowns are lifted…..


Among all NDIS participants, not just those in group homes, 39.9% had been fully vaccinated at 15 September……


As at 30 June 2021 in Northern NSW, the National Disability Insurance Scheme (NDIS) had 6,903 active participants (ranging from children to older adults) with diagnosed disabilities which included; Acquired Brain Injury, Autism, Cerebral Palsy, Developmental Delay, Global Developmental Delay, Hearing Impairment, Intellectual Disability, Multiple Sclerosis, as well as other Neurological, Physical, Sensory & Speech disabilities.

All those wonderful women who marched and those who support them in Australia 2021

 


On 15 March 2015 women and girls marched in villages, towns and citiesspread across Australia from coast to coast.

They marched demanding that gender-based violence against women and children stop.

A demand which insists that the federal government listen, act and lead a long overdue change in institutional attitudes which either turn a blind eye to or openly condone sexual assault, sexual harassment, domestic violence, the double burden for many women of gender based discrimination coupled with racial discrimination and, a shameful murder rate which sees women murdered by their current partners or former partners at the rate of one woman every nine days [House of Representatives, Hansard, p.62].

1 Introduction
1.1 Executive Summary

(a) The National Inquiry into Sexual Harassment in Australian Workplaces

Workplace sexual harassment is prevalent and pervasive: it occurs in every industry, in every location and at every level, in Australian workplaces. Australians, across the country, are suffering the financial, social, emotional, physical and psychological harm associated with sexual harassment. This is particularly so for women.

This behaviour also represents a very real financial impost to the economy through lost productivity, staff turnover and other associated impacts.

In June 2018, against the backdrop of the momentum of the #MeToo movement and recognition of the prevalence of, and immense harm caused by sexual harassment in Australian, and global, workplaces, the Sex Discrimination Commissioner, Kate Jenkins, and the then Minister for Women, the Hon Kelly O’Dwyer, announced the National Inquiry into Sexual Harassment in Australian Workplaces (Inquiry).

As Australia’s national human rights institution, the Australian Human Rights Commission (the Commission) was tasked with undertaking this Inquiry. The Commission has an established record of undertaking initiatives aimed at addressing sexual harassment and promoting gender equality.

In the Terms of Reference, the Commission’s task was to review and report on workplace sexual harassment and make recommendations in relation to:

    • its prevalence, nature and reporting in Australian workplaces
    • the role of technology
    • its drivers, including risk factors for particular population groups or in  different workplace settings
    • the current legal framework
    • existing measures to address it and examples of good practice
    • its impacts on individuals and businesses, including its economic impact.

This report outlines the Commission’s findings and recommendations. The full list of recommendations is set out at the end of this Executive Summary.

The purpose of this Inquiry is to improve how Australian workplaces prevent and respond to sexual harassment, including through an examination of the systemic issues set out in its Terms of Reference.

The Commission established a Reference Group to provide advice and guidance for the Inquiry. It included members from across government, business groups, unions, academia and the legal and community sector (see Section 1.4(b) for a list of members). The Commission acknowledges and thanks Reference Group members for their valuable assistance with engaging stakeholders and providing frank and robust advice and guidance on the Inquiry.

The Commission received 460 submissions from government agencies, business groups, community bodies and, above all, victims. From September 2018 to February 2019, the Commission conducted 60 consultations as part of the Inquiry, with more than 600 individuals participating in all capital cities and some regional locations across Australia. It also held three roundtables and numerous meetings with key stakeholders.

This report is a reflection of the contributions of many individuals and organisations and the Commission is grateful to those who took the time to attend a consultation, write a submission or assist the Inquiry.

There is an urgency and demand for change across all corners of society.

Australia is also being closely watched internationally. This is Australia’s moment to be a global leader on this important and topical issue.

Australia's National Disability Insurance Scheme in 2020-21




In December 2019 the Morrison Coalition Government was handed the Review of the NDIS Act report.


This report was published and reported on in January 2020 and the Morrison Government released its formal response in August 2020.


Concerns about details in the Morrison Government's response and other statements by the department and minister responsible led the parliamentary Joint Standing Committee on the National Disability Insurance Scheme to issue this media release on 16 December 2020:


COMMITTEE LAUNCHES INQUIRY INTO INDEPENDENT ASSESSMENTS


The Joint Standing Committee on the National Disability Insurance Scheme (NDIS) will conduct an inquiry into independent assessments under the NDIS. 


An independent assessment is an assessment of a person’s functional capacity, which will be used to inform decisions about eligibility for the NDIS and about funding in a participant’s plan. 


The National Disability Insurance Agency proposes to introduce independent assessments as part of the NDIS access and planning processes in 2021. 


“Through its other inquiries, the committee has heard that many stakeholders—particularly in the disability and allied health sectors—have strong concerns about the independent assessments process, and about how assessments will be used to inform access and planning decisions,” Committee Chair, the Hon Kevin Andrews said. 


The inquiry will have a particular focus on: 


• the rationale for introducing independent assessments into the NDIS, and the evidence to support this decision; 


• the assessment process and its impacts; 


• the implications of independent assessments for NDIS access and planning decisions; and 


• the appropriateness of independent assessments for particular cohorts of people with disability. 


The committee is particularly interested in hearing from people with disability, families and carers; allied health professionals; and representative organisations.

Social Security (Administration) Amendment (Continuation of Cashless Welfare) Bill 2020 on its way to Governor-General for assent - list of all MPs and Senators who voted for the bill

The bill passed in the House of Representatives unamended on 7 December 2020 by a vote of 62 to 61.

A reminder that the Morrison Government's extension of the Indue Cashless Debit Card is due to commence in stages from 2021 onwards

The Indue Cashless Debit Card is a federal government program which locks 80 per cent of an individual's periodic social security cash transfer payments into that card and dictates what that card can be used to purchase. The remaining 20 per cent of an individual's social security payment is periodically paid into that individual's personal bank account.

The debit card program applies to every person between 15 and 65 years of age who receives a Centrelink pension, benefit or payment - other than Age and Veterans Affairs pensions which are currently exempt.

On 8 October 2020 the Morrison Government introduced into the House of Representatives the Social Security (Administration) Amendment (Continuation of Cashless Welfare) Bill 2020 which:

"Amends the Social Security (Administration) Act 1999 to: remove the trial parameters to establish the Cashless Debit Card (CDC) as an ongoing program; establish the Northern Territory and Cape York areas as CDC program areas and transition income management participants in these areas to the CDC program in 2021; remove a current exclusion to enable people in the Bundaberg and Hervey Bay program area to voluntary participate in the CDC program; enable a voluntary participant to continue to volunteer for the CDC even if they no longer reside in a program area; enable the secretary to advise a community body when a person has exited the CDC program; enable the minister to determine decision-making principles for the purposes of determining whether a person can demonstrate reasonable and responsible management of the person's affairs; enable the secretary to review a wellbeing exemption or exit determination in certain circumstances and remove the determination as a result of such a review; enable the secretary to issue and revoke a notice informing a person that they are a CDC program participant; remove the requirement that an evaluation be conducted by an independent expert of a review of the CDC program; and extend the sunset date for income management in Cape York from 30 June 2020 to 31 December 2021."

This bill reached the Third Reading stage unamended and on 7 December 2020 passed the Lower House by a vote of 62 to 61 (See list at end of post for names & electorates). It is now before the Senate.

When this bill finally becomes legislation all welfare recipients (with the exception of Age and Veterans Affairs pensioners) in the Ceduna SA, East Kimberley WA, Goldfields SA areas will be compulsorily placed on the Indue Cashless Debit Card and all persons in Cape York, Qld and the Northern Territory currently having their income managed will be compulsorily transferred to the Indue Cashless Debit Card.


This forced transfer applies even if during the trial period a welfare recipient was a voluntary trial participant and, all monies held in other income management accounts such as the Basics Card will be immediately transferred over to the forced participant's Indue Cashless Debit Card.


Welfare recipients in the Bundaberg and Hervey Bay areas in Queensland who were voluntary cashless debit card trial participants will be compulsorily transferred to the ongoing Indue Cashless Debit Card program.


The Age Pension is now included as a welfare payment which will be a restrictable payment and therefore included in the Indue Cashless Debit Card program of those who have entered or will enter the program voluntarily and can be included as a restrictable payment in the Cape York area on a case by case basis for involuntary participants.


The cashless debit card program began its trial rollout on 15 March 2016 and yet, according to card holders, after four years Indue Ltd:
  • still fails to reliably make scheduled payments on time when it comes to regular mortgage, rent, electricity, gas, telephone/internet accounts due and program participants therefore incur late fees, receive letters threatening non-renewal of a lease/eviction or their credit rating begins to suffer;
  • will suddenly decline payment at supermarkets, clothing, electrical/white goods and assorted other stores without explanation, even when there is more than enough money on a participant's debit card to pay;
  • will reject use of the debit card for online purchases for absurd reasons - such as not allowed to buy a non-fiction book because the online bookstore might sell books on how to make alcoholic drinks and, not allowed to buy a stethoscope for educational course work because the online site sells hand sanitiser which contains alcohol as one of its ingredients: 
  • still has instances where a participant's money disappears from an account which shows a credit balance and repayment of this cash transfer error is not corrected for weeks; and
  • still has an IT (including AI) system vulnerable to internal/external outages which leave participants without the ability to use the debit card;
  • still does not save and store the details of cashless debit card participant accounts, instead requiring the payer to enter full details for each one-off payment; and
  • still has not managed a satisfactory patch of Indue app problems. 

Matters to Note:


The Social Security (Administration) Amendment (Continuation of Cashless Welfare) Bill 2020 does not rule out the federal government increasing the number of designated program areas within the states at some future date.


At all times the federal government reserves the right to monitor how Cashless Debit Card users are spending their money.


Most of the existing financial institution guidelines and regulations do not appear to apply to Indue Ltd's contract to manage the federal government's Cashless Debit Card program and consumer protection also seems to be minimal.


It is not certain if, once the Cashless Debit Card changes from a trial to an ongoing program, it is still covered by the federal government's Financial Claims Scheme.  Nor is it certain if, on death, the balance in the Indue Ltd account of a cashless debit card program participant becomes part of their estate or if it can lawfully be retained by Indue for payment of unspecified fees and charges.


Since May 2020 Indue Ltd pays interest on the balance held in a participant's cashless debit card account. However, the interest rate is decided by the federal government so it is unlikely to ever rise higher than somewhere between 0.01 per cent and 1.0 per cent.


The total daily payment limit on the Cashless Debit Card is currently set by default at $10,000.
