State Member for Lismore Janelle Saffin is calling for a blanket ban on mineral mining in the Northern Rivers region to protect water catchments which feed into the Clarence, Richmond and Tweed river systems

Gold, silver, copper & cobalt diggers’ be gone


STATE Member for Lismore Janelle Saffin is calling for a blanket ban on mineral mining in the Northern Rivers region to protect water catchments which feed into the Clarence, Richmond and Tweed river systems.


Ms Saffin wants the NSW Government to agree to a moratorium on mineral mining, revoking all licences for exploration or active mining, and financially compensating affected companies like it did with Shenua’s open-cut coal mine near Gunnedah.

Ms Saffin says she stands with thousands of local residents campaigning against a wave of ‘gold, silver copper and cobalt diggers’ who have our pristine back country firmly in their sights.


As Federal Member for Page from 2007 to 2013, Ms Saffin worked with local communities to repel the Coal Seam Gas industry from the region because of the threat to our water resources, and continues to support the activism of the Knitting Nannas.


And before this, as Labor’s candidate for Page, she helped torpedo Federal Coalition plans to dam and divert the mighty Clarence River inland.


I’m proud of my track record of protecting our most precious resource – water – and our traditional industries like farming, fishing and tourism which help to sustain the economic prosperity of our local communities,” Ms Saffin said.


“’The Nationals in Government’ appear to be prepared to ignore the groundswell of anti-mining sentiment in their electorates to appease mining companies who will come and plunder for quick profits then potentially leave an environmental mess behind for future generations.”


With Parliament resuming next week, and despite COVID-19 issues expecting to dominate, Ms Saffin will speak on the fundamental need to protect our water during a debate scheduled in the Legislative Assembly on Thursday, 14 October.


This debate was triggered after Ms Saffin on 9 June submitted a community petition with the Lower House, calling for a moratorium on future mineral mining, both exploratory or active, in the Clarence Catchment and surrounding Local Government Areas.


The petition was collected by the Clarence Catchment Alliance and has been signed by almost 11,000 mainly local residents of the Clarence Valley and Northern Rivers.


I have met with Alliance representatives and agree that the risks of tailings dam failure from mineral mining, which is quite different from normal quarry operations, are too high, particularly in our high rainfall and floodprone region,” Ms Saffin said.


I see where five councils – Kyogle, Coffs Harbour City, Bellingen Shire, Glen Innes-Severn Shire and Byron Shire -- have shown solidarity with Clarence Valley Council’s resolution seeking a mining moratorium in the Clarence Valley and which former Deputy Premier John Barilaro effectively ignored.”

NSW Nationals MLA for Clarence Chris Gulaptis intends to fight against community and Clarence Valley Council opposition to mining in the Clarence River catchment

The employment history of NSW Nationals MLA for Clarence & Parliamentary Secretary for Agriculture and Forestry Chris Gulaptis (left) shows that from 2006-2007 he was involved with Land Partners Limited (formerly Aspect North & KFM Partnership) – a company which participated in the planning, design and construction phases of the Eastern Gas Pipeline in 1999-2000.


It also shows commencing around 2009 and presumably finishing when he won NSW Nationals pre-selection for the Clarence by-election in 2011, he was a senior operations manager for Brazier Motti Pty Ltd engineering and mining surveyors in Mackay, Queensland – a position he used to enthusiastically support the mining industry.


In 2007, 2012 and 2013 Gulaptis supported coal seam gas exploration on the NSW North Coast - including in the Clarence Valley.


The Berejiklian Government of which Gulaptis is a member is subsidisng mining exploration. Currently it has granted Perth-based Corazon Mining Limited a reimbursement of 50 per cent of per-metre drilling costs, up to a maximum of $200,000 with regard to its cobalt-copper-gold exploration lease near Mt. Gilmore (approximately 25km northwest of Grafton) in the Clarence River catchment area as part of the state's New Frontiers Cooperative Drilling program. 


So this comes as no surprise......

Political Inconsistency



The Clarence Catchment Alliance (CCA) has campaigned strongly for the past three years, educating the community on the potential threats posed by mining to our Clarence Valley environment, particularly water quality.



During that campaign, CCA volunteers diligently collected over 10,000 signatures on a petition calling for a ban on mining in the Clarence River catchment. That petition has been tabled in State Parliament and is scheduled for debate.



The Clarence Valley Council’s motion calling on the State Government to impose a moratorium on mining within the LGA, would have been partially prompted by that campaign, and the community support it generated.



The CCA took their concerns, via Zoom, to local State Member, Mr Gulaptis, on 23rd April, where he vigorously argued that mining should be allowed, with any risks effectively managed by the stringent conditions that would be imposed. He also indicated he would be speaking to the Parliamentary debate, arguing against a ban on mining in his electorate.



So, when reading the ‘Northern Star’ the following day, specifically its article on the Dunoon Dam debate, the CCA team could be excused for being more than a little perplexed. The reason being, that on the very same day that Mr Gulaptis belittled the CCA’s campaign, and dismissed its 10,000-signature petition as NIMBYism, he is quoted as stating:



“… it is vital our communities have a clean and reliable water source.”, and then finished with: “It is often said that local government is the government closest to the people. Clearly that is not the case of the five elected councillors (that voted against the Dunoon Dam proposal) in this instance, who are ignoring the will of more than 10,000 constituents”.



Mr Gulaptis had previously been strongly critical of Clarence Valley Council, when it took notice of the more than 10,000 people who signed the CCA’s petition, and called on the State Government to impose a moratorium on mining.



It seems that some politicians only feel a need to consider the will of their constituents if it happens to agree with their own philosophy.

Pathetically low fines for non-compliance with rules enforced by the Natural Resources Access Regulator (NRAR) leaves Murray-Darling Basin irrigators in NSW laughing all the way to the bank with those dollars earned from what is essentially water theft

The State of New South Wales is currently not in drought. However, its rivers often have highly variable water flows so it was not surprising to find the morning of Tuesday 13 July 2021 revealing that WaterNSW State Overview real time data record showed that 14 of the state's rivers were flowing at less than 20%. While 15 of the state's principal dams registered volume levels at between 31.4% and 95.9% of capacity, with another 3 registering over 100% of recommended capacity.


Some of those rivers and dams fall within Murray Darling Basin boundaries.


Apparently - even in time of relative water plenty - healthy rivers, environmental water flows and intergenerational equity are not part of the business plan for many of the irrigators growing cotton, almonds, rice, fruit, vegetables, grape vines and other food & pasture crops - how else does one explain this?

Nearly half of the biggest irrigators in NSW have made no effort to install meters that comply with new water laws more than six months after they became mandatory, an audit has found.


The NSW Natural Resources Access Regulator found that 45 per cent of large pumps that draw from rivers and creeks were not using compliant meters to measure how much water was taken, contrary to new laws designed to prevent water theft.


Only 23 per cent were fully compliant with a further third on their way to compliance based on evidence provided by way of invoices, product orders and emails confirming validation appointments.


NRAR’s chief regulatory officer Grant Barnes said there had been “a positive shift” in compliance rates since its desktop audit in April, which found two-thirds of irrigators were non-compliant, but there was still more work to be done with those water users who had neither installed the meters nor made an effort to do so.


For us, this is about ensuring those water users who have done the right thing and have complied with the regulations get a fair go, and so these results will be disappointing to those people,” Mr Barnes said. “[Compliance] is also important to those who recognise the importance of a social licence for irrigators.”


Individuals who have shown no effort to comply face fines of up to $750 and irrigation companies face $1500 fines.


The pumps in question here are gigantic, half-meter diameter straws that have the capacity to suck the lifeblood out of our rivers.”

The meters were a central recommendation from the 2017 Murray Darling Basin Compliance Review, which found irrigator compliance in NSW and Queensland was “bedevilled by patchy metering, the challenges of measuring unmetered take and the lack of real-time, accurate water accounts”…...

The National Water Reform Draft Report has been released - now is the time for concerned Australians to speak up and loudly


If there is one thing that Australians know well by now, it is that state and federal governments frequently take from major reports only those points and recommendations which fit with their own political world view and/or those that can be easily distorted to meet the expectations of their party's financial backers - thus ensuring that little positive change occurs .


Water is the basis of life, without it communities perish and nations go into decline. That is one of the hard facts facing Australia as the impacts of climate change start to bite.


It is time for people to stand up in defence of this country's river and ground water systems and make sure governments understand that the environmental, economic and cultural vandalism they have supported in the past will no longer be tolerated in the present or the future.

Most Australians know all too well how precious water is. Sydney just experienced a severe drought, while towns across New South Wales and Queensland ran out of drinking water. Under climate change, the situation will become more dire, and more common. 


It wasn’t meant to be this way. In 2004, federal, state and territory governments signed up to the National Water Initiative. It was meant to secure Australia’s water supplies through better governance and plans for sustainable use across industry, environment and the community. 


But a report by the Productivity Commission released today says the policy must be updated. It found the National Water Initiative is not fit for the challenges of climate change, a growing population and our changing perceptions of how we value water. 


The report’s findings matter to all Australians, whether you live in a city or a drought-ravaged town. If governments don’t manage water better, on our behalf, then entire communities may disappear. Agriculture will suffer and nature will continue to degrade. It’s time for a change.


The report acknowledges progress in national water reform, and says Australia’s allocation of water resources has improved. But the commission makes clear there’s still much to be done, including: 


  • making water infrastructure projects a critical part of the National Water Initiative 


  • explicitly recognising how climate change threatens water-sharing agreement between states, users, towns, agriculture and the environment 


  • more meaningful recognition of Indigenous rights to water delivering adequate drinking water quality to all Australians, including those in regional and remote communities, especially during drought 


  • all states committing to drought management plans.

A new national water reform report is inundated with positivity. But a closer look leaves you with a sinking feeling.


A glance at the draft report on national water reform from the Productivity Commission reminds me of the repeated judgment from old Mr Grace, the doddering owner of the department store in Are You Being Served? as he headed for the door: "You've all done very well!"


Its review of the progress of the National Water Initiative signed by the federal and state governments in 2004 - encompassing agreements on the Murray-Darling Basin - is terribly polite and relentlessly upbeat.


Apparently, governments have made "good progress" in having "largely achieved" their reform commitments. All that remains is just the need for a teensy-weensy bit of "policy renewal".


This mild-mannered stuff and congratulatory tone bear no resemblance to my memories of meetings of angry farmers railing against stupid greenies and other city slickers; of their insistence that the immediate needs of irrigators and irrigation towns along the river take priority over the river system's ultimate survival; of state governments' insistence on favouring their own irrigators over those in states further down the river; of federal and state National Party ministers happy to slip farmers a quiet favour, turning a blind eye to blatant infringements of the rules; of federal Labor ministers who, even with no seats to lose in the region, were unwilling to make themselves unpopular by standing up for the rivers' future.


I remember that the Howard government spent billions helping individual farmers make their irrigation systems more resistant to evaporation and seepage when all the benefits went to the farmer and none to the river system.


I remember all the infighting between government water agencies, and the mass fish kills during the recent drought in NSW and Queensland, for which the managers of the system accepted no responsibility.


Fortunately, reporters are adept at ignoring all the happy flannel up the front of government reports and finding the carefully hidden bad bits. And we have the assistance of water experts, including Professor Quentin Grafton, of the Australian National University, whose summary of the report in The Conversation is headed: "Our national water policy is outdated, unfair and not fit for climate challenges."


"If governments don't manage water better ... entire communities may disappear. Agriculture will suffer and nature will continue to degrade," he says.


The report's proposal to make "water infrastructure developments" a much larger part of the National Water Initiative is a critical way to keep governments honest. For years, state and federal governments have used taxpayers' dollars to pay for farming water infrastructure that largely benefits big corporate irrigators, Grafton says.


Last year the Morrison government announced a further $2 billion for its Building 21st Century Water Infrastructure project. Such megaprojects, he says, perpetuate the myth that Australia - the driest inhabited continent on Earth - can be "drought-proofed".


When governments signed the original initiative in 2004, they agreed to ensure investments in infrastructure would be both economically viable and ecologically sustainable. But many projects appear to be neither.


The report notes, for example, that building the Dungowan Dam in NSW means "any infrastructure that improves reliability for one user will affect water availability for others". The "prospect of 'new' water is illusory". Projects that aren't economically viable or ecologically sustainable can "burden taxpayers with ongoing costs, discourage efficient water use" and create long-lived impacts on communities and the environment", the report warns.


Equally disturbing is that billions of dollars for water infrastructure are presently targeted primarily at the agriculture and mining industries, while communities in desperate need of clean drinking water miss out, Grafton says.


Luckily, the report isn't so house trained as to avoid mentioning the gorilla the Morrison government prefers not to notice. There's a lot about the consequences of climate change. It says droughts will likely become more intense and frequent and, in many places, water will become scarce.


In Grafton's summary, the report says planning provisions were inadequate to deal with both the millennium drought and the recent drought in Eastern Australia. The 2012 Murray-Darling Basin Plan, for instance, took no account of climate change when determining how much water to take from waterways.


The present federal government actually dismantled the National Water Commission in 2015, so we no longer have a resourced, well-informed agency to "mark the homework" and make sure the reforms were being implemented as agreed, Grafton says.


In 2007, the worst year of the millennium drought - and the year John Howard feared he'd lose the election if he didn't match Labor's promise to introduce an emissions trading scheme - Howard remarked that "in a protracted drought, and with the prospect of long-term climate change, we need radical and permanent change".


Professor Grafton says we're still waiting for that change. "If Australia is to be prosperous and liveable into the future, governments must urgently implement water reform."

Elders and Widjabul Wia-bal people: ‘We are tired of being ‘consulted’ and then ignored. Enough is enough.’

Widjabul Wia-bal traditional owners of the area between Dunoon and the Channon have told Rous County Council not to follow Rio Tinto with the destructive Dunoon Dam.


They have told the General Manager of Rous County Council, Phil Rudd, that they will not accept the building of the proposed dam, which would inundate ancient burial sites and extensive evidence of occupation in the past and in recent times.


John Roberts, a Senior Elder of the Widjabul Wia-bal said, ‘I was one of the stakeholders consulted in 2011 about the impact of the Dunoon Dam on cultural heritage.


In the 2011 Cultural Heritage Impact Assessment prepared for Rous, we stakeholders said with one voice that no level of disturbance was acceptable to us. We still say that. Nothing has changed. There is no need for another study. Our opinion has not changed.


Our cultural heritage is a direct connection to our ancestors. We have been here for thousands of years. These sites provide us with a link to our traditions, our land and our living heritage. They allow us to educate our young ones in their history.’


Unanimous decision


A unanimous decision of Elders and Widjabul Wia-bal people was given to the Rous County Council General Manager last Tuesday, December 8th.


The group insisted that Rous abandon plans for the Dunoon Dam.


So many of our cultural sites have been destroyed. To destroy more is unacceptable to the traditional owners,’ said Mr Roberts.


We are tired of being ‘consulted’ and then ignored. Enough is enough.’


The Widjabul Wia-bal collective insisted that Rous County Council no longer deals with individuals. They said in future Rous must consult with the whole stakeholder group.


Rous have agreed to provide all correspondence between Rous and the Widjabul Wia-bal representatives since the dam was first mooted in 1995……


Rous County Council, meanwhile, have issued a statement saying they will table their plan to future-proof the region’s water supply at their next ordinary meeting, on 16 December 2020.

The statement said, ‘The combination of solutions set out by the Future Water Project 2060 include:


  • Utilisation of the Marom Creek Water Treatment Plant for the increased use of groundwater from the Alstonville area.

  • Further detailed investigations into the viability of the proposed Dunoon Dam.

  • Ongoing water conservation and demand management.

  • Pioneering investigations into water reuse.


Councillors will carefully consider the plan in light of the outcome of a 10-week public exhibition of the Future Water Project 2060. Council acknowledges the community’s concerns and aspirations and greatly appreciates the time invested by those who made a submission.’

Dunoon local Jill Hawthorn responded on social media by saying, ‘When the experts say we need back up options for dry times coming – and 30% of our water system should be not rain dependent. This means we need to look seriously at water reuse and solar powered desalination – can you hear your community Rous?

Water Security State of Play: NSW Northern Rivers December 2020

 

As of 26 November 2020 an estimated 80.5 per cent of the NSW Northern Rivers region was not in drought. However, 1 per cent of the region was in full-blown drought, another 10 per cent drought affected and 8.2 per cent recovering, according to the NSW Dept. of Primary Industries.


By 2 December urban water supply in the region was coping but beginning to fall markedly. 


Clarence Valley Council sources its urban water from the Shannon Creek Dam and the Nymboida River Weir. Currently Shannon Creek Dam is at 84 per cent capacity and water flow at Nymboida Weir is well below safe extraction level. Level One water restrictions are in place across the valley.


Ballina Shire Council, Byron Shire Council, Lismore City Council and Richmond Valley Council all principally source their urban water through Rous County Council. The two dams in this cluster are currently at 90 per cent (Rocky Creek) and 89 per cent (Emigrant Creek). With Mullumbimby in Byron Shire sourcing its water from council’s own Laverty’s Weir. Everyday water restrictions apply in all four local government area ie., recommended water use of 160 litres per person per day.


Kyogle Shire Council draws its urban water from a weir on the Richmond River, a natural weir pool on Tooloom Creek and the small Petrochilos Dam with under gravel pump extraction from nearby Peacock Creek. Level One water restrictions are in place across the shire.


Toonumbar embankment dam on Iron Pot Creek about 30 kilometres west of Kyogle was at 55.7 percent of capacity on 30 November 2020.


Tweed Shire Council draws its urban water from the freshwater section of the Tweed River at Bray Park Weir, Clarrie Hall Dam and the weir pool on Tyalgum Creek (Oxley River). Due to low rainfall the Tyalgum district is now on Level Two water restrictions.


The Australian Bureau of Meteorology rainfall and temperature predictions for January to March 2021 show that though the rest of summer may be hot across much of the Northern Rivers region there is reason to hope that rainfall will be adequate to meet our needs.

Quite rightly NSW Government refuses request not to release environmental flow waters into Shannon Creek - Clarence Valley & Coffs Harbour City councils expected to honour their undertakings

North Coast local council areas will be forced back onto Level One water restrictions after the State Government refused a request from Clarence Valley and Coffs Harbour councils to keep more than two billion litres of water in the Shannon Creek Dam. 


Clarence Valley Council water cycle manager Greg Mashiah said a one-time exemption to the NSW Government’s license agreement had been requested, however, a verbal response had now been received declining the request. 


“Under our transparent extraction licence we need to release all the water that flows down the Shannon Creek into the dam,” he said. “This mimics the natural flow of the creek – the volume of water flowing into the dam must equal the volume flowing out.” Mr Mashiah said the water that came into the dam from Shannon Creek during the February flood had not yet been released. “We are currently waiting for written advice from the NSW Government with instructions on how they want the release to take place,” he said.

CLARENCE RIVER CATCHMENT 2020: a culturally, economically, environmentally & socially harmful number of mining applications are in the process of getting the nod from the NSW Berejiklian Coalition Government

Of particular concern to council and the wider valley community is the yet to be completed Mole River dam in Tenterfield shire which has previously been mooted as a holding dam for the diversion of Clarence River catchment water elsewhere by Clarence water first being sent into the Upper Mole River.


That brings to three the number of companies currently undertaking exploration mining in the Clarence Valley. 


Given that the number of exploration licenses applied for or granted in the Clarence River catchment area have grown rapidly in 2020, the level of concern for the headwaters of so many rivers and creeks in also rising in Clarence Valley communities.

Needless to say the NSW Nationals MP for Clarence Chris Gulaptis, former surveyor, property developer and operations manager with a Qld resources/mining consultancy firm, thinks this map is just fine and dandy - nothing to see hear, move along.

Regional town water security virtually ignored for last six years by NSW Coalition Government


The NSW Auditor General’s audit report of 24 September 2020, titled Support for regional town water infrastructure, reveals that state government has failed to meet its responsibilities and fulfil its undertaking for the last six years under the leadership first of Liberal Premier Barry O’Farrell, then of Liberal Premier Bruce Baird and finally of Liberal Premier Gladys Berejiklian 

In fact NSW Liberal and Nationals politicians didn't begin to get even remotely serious about regional town water security until 2018-19.

Audit Report Executive Summary, excerpt:

"The Department of Planning, Industry and Environment (the department) is the lead agency for water resource policy, regulation and planning in NSW. It is also responsible for ensuring water management is consistent with the shared commitments of the Australian, State and Territory Governments under the National Water Initiative. This includes the provision of healthy, safe and reliable water supplies, and reporting on the performance of water utilities.

Ninety-two Local Water Utilities (LWUs) plan for, price and deliver town water services in regional NSW. Eighty-nine are operated by local councils under the New South Wales’ Local Government Act 1993, and other LWUs exercise their functions under the WM Act. The Minister for Water, Property and Housing is the responsible minister for water supply functions under both acts.

Audit Report Conclusion, section in full:

The Department of Planning, Industry and Environment has not effectively supported or overseen town water infrastructure planning in regional NSW since at least 2014. It has also lacked a strategic, evidence-based approach to target investments in town water infrastructure.

A continued focus on coordinating town water planning, investments and sector engagement is needed for the department to more effectively support, plan for and fund town water infrastructure, and work with Local Water Utilities to help avoid future shortages of safe water in regional towns and cities.

The department has had limited impact on facilitating Local Water Utilities’ (LWU) strategic town water planning. Its lack of internal procedures, records and data mean that the department cannot demonstrate it has effectively engaged, guided or supported the LWU sector in Integrated Water Cycle Management (IWCM) planning over the past six years. Today, less than ten per cent of the 92 LWUs have an IWCM strategy approved by the department.

The department did not design or implement a strategic approach for targeting town water infrastructure investment through its $1 billion Safe and Secure Water Program (SSWP). Most projects in the program were reviewed by a technical panel but there was limited evidence available about regional and local priorities to inform strategic project assessments. About a third of funded SSWP projects were recommended via various alternative processes that were not transparent. The department also lacks systems for integrated project monitoring and program evaluation to determine the contribution of its investments to improved town water outcomes for communities. The department has recently developed a risk-based framework to inform future town water infrastructure funding priorities.

The department does not have strategic water plans in place at state and regional levels: a key objective of these is to improve town water for regional communities. The department started a program of regional water planning in 2018, following the NSW Government’s commitment to this in 2014. New South Wales 2020: the problem of water greed & outright theft

The rapid growth of blueberry and other intensive farming in northern NSW has prompted a crackdown on illegal water use and sparked concerns about pollution in rivers and in the state's first marine conservation area.

The Natural Resources Access Regulator found 28 of 31 farms it inspected around the Coffs Harbour region in the first two stages of the clampdown were allegedly non-compliant with water laws.

The regulator said in the five years prior to the start of the campaign, agencies received more than 130 reports of alleged breaches in the region. "This potentially indicated a high level of non-compliance," a spokeswoman for the regulator said.

For the first two phases, the regulator ordered 13 farms to reduce the capacity of dams among 25 directions. Other actions include 20 penalty notices, with more likely after a third stage of investigations last month.

The problems stem in part from the conversion of banana farms to blueberries, raspberries and cucumbers, among other products, in the past two decades. Farms with set water licences have been subdivided, with new owners apparently adding bores, pumps and even dams on the smaller plots.

Water quality, too, has been compromised as the more intensive crops increase the use of fertilisers, pesticides and other chemicals. That's prompted the Coffs Harbour City Council to commission multiple studies by researchers from the Southern Cross University, among others.

One report found levels of nitrogen soared after rains as fertiliser from farms washed into rivers, reaching 695 times that of drier conditions.

"These [nitrogen oxide] loads were amongst the highest reported for catchments on the east coast of Australia, and similar to loads in rivers throughout China, Europe and India with strong agricultural or urban influences," the 2018 study found.

Shane White, one of the Southern Cross University researchers, said the Coffs region is prone to short, heavy rain bursts. Soils in the hilly area are typically shallow and sit on a clay base that limits the absorption of water, leading to significant run-off….

Breaches of NSW water laws have also been found in the Northern Rivers area in 2020 to date - 1 direction notice and 2 penalty notices have been issued to Clarence Valley LGA landowners, 2 direction notices to Ballina LGA landowners, 3 penalty notices to Byron Bay LGA landowners, 3 penalty notices to Lismore LGA landowners and 1 direction notice and 3 penalty notices for Tweed LGA landowners.
